 MEMBERSHIP TERMS AND CONDITIONS

Enrollment

1. Eligibility: Membership in the program are open to individuals at least 18 years old who possess legal authority to agree to these terms, agree to the website terms of service, and consent to the privacy policy. Each authorized Member must follow GO KIDZ rules, procedures, policies, instructions, and have a photo with that Member’s participant and arbitration agreement, indemnification, general release, and assumption (“Waiver”) signed waiver, which will be stored in the GO KIDZ database. Member hereby expressly authorizes storage of his or her personal data GO KIDZ database. A Member must have a proper photo and Waiver on file with GO KIDZ point of sale software. Photos on file for active Members must be periodically updated with current photos. At this time, Members must replace their photos every year. Further identification may be required. A Member must have his/her valid Waiver on file. Waivers must be updated at least once per calendar year.

Memberships are not applicable for private or special events, which include but are not limited to birthday celebrations, field trips, group activities, and other events or promotions that necessitate separate admission, unless explicitly stated otherwise. Memberships are non-transferable and remain the property of GO KIDZ. They are valid solely for the registered child or children and cannot be transferred to others.

 

Members may choose not to renew their membership during the final month of their expired membership. However, it is essential to cancel before the next scheduled payment to avoid being charged the full membership fee.

 

Should a member fail to cancel in a timely manner and the payment is executed, the member will incur the full membership fee. Memberships are non-refundable. Once a payment has been processed, no refunds, no credits, or prorated amounts will be issued for any reason. Certain restrictions may apply, including, but not limited to, capacity limitations and other closures. Additionally, memberships may not be utilized for commercial purposes and will be rendered invalid if altered or misused. A Member assumes the inherent risks associated with the operation or use of all attractions and trampolines should read and obey all safety signage, instructions, and rules. Parks, services, entertainment and attractions may change operating hours, close temporarily, or may otherwise change or be discontinued without notice and without liability. GO KIDZ is not responsible for lost or stolen property or items. Members must abide by any rules and regulations applicable to GO KIDZ or to the use of the Memberships as promulgated by GO KIDZ from time to time. Memberships are valid only at the location of purchase. By enrolling in the program, you represent that you meet these eligibility requirements.

2. Sign up : To enroll in the program, you must provide your information. By providing your information, you agree to these terms and consent to receive communications from us related to the program.

 

Program Limitations 

1. Changes to Program : GO KIDZ reserves the right to modify, suspend, or terminate the program or these terms at any time, with or without notice. Any changes will take effect immediately upon posting the revised terms on our website.

2. Program Termination : GO KIDZ reserves the right to cancel, suspend, or revoke any Membership program or deny park admission to any Member at any time, and for any reason deemed necessary. Such actions may occur in response to misuse, delinquency, or a failure to comply with park rules and regulations. Should a Membership be terminated, the associated Membership Plan will be permanently deactivated.

3. Restrictions : The program is non-transferable and can only be redeemed by the account holder.

4. Membership Term And Recurring Payment Authorization : 

By entering into this Agreement, you are committing to the selected membership term associated with your chosen membership plan. Each Membership Plan consists of an initial term and includes an automatically renewing membership for subsequent time periods.

• Membership Term: The available membership options are outlined below.

  • Month to Month (Six Months) Membership:

Selecting this option involves an Initial Term of six months with a month-to-month payment arrangement, during which you may not cancel your membership, unless specified in the membership agreement. Upon completion of the Initial Term, this Agreement will automatically renew for an additional six-month Renewal Term and will continue unless terminated by either party in accordance with the terms outlined herein.

• Prepaid Six-Month Membership:

Selecting this option involves an Initial Term of six months with a prepaid payment arrangement, during which you may not cancel your membership, unless specified in the membership agreement. Upon completion of the Initial Term, this Agreement will automatically renew for an additional six-month Renewal Term and will continue unless terminated by either party in accordance with the terms outlined herein.

• Payment and Recurring Payment Authorization:

By accepting this Agreement, you authorize us to automatically charge the card on file for the following: (1) the total cost of the selected Membership Plan and applicable taxes on the date of acceptance; (2) Upon enrollment in an annual or monthly membership plan, the initial recurring payment, along with any applicable taxes, will be processed on the date of acceptance. Following this, subsequent annual or monthly charges will occur around the same date each year or each month, continuing until the Agreement is either canceled or terminated in accordance with its stipulated terms; (3) to facilitate payment for any goods or services received or charges incurred pursuant to this Agreement; and (4) any other fees and charges incurred under this Agreement, including but not limited to applicable taxes and government fees.

 

During the membership signup process, you are required to select a valid payment method to settle any amounts due under this Agreement. For recurring payments, charges will occur on or about the same date of acceptance (for example, if registration occurs on the 10th of the month, the card will be charged on or about the 10th of each subsequent month). The amounts owed will be due and payable on the date we attempt to charge your card.

 

For identification and billing purposes, you agree to provide accurate and updated information, including your name, address, telephone number, and payment data. It is your responsibility to promptly inform us of any changes to this information, including updates to your payment method. Modifications to the designated payment card or access to invoice details can be managed through the GO KIDZ guest portal at www.gokidzcolorado.aluvii.com/guest.

 

If you choose to enroll in a membership plan, please be advised that we reserve the right to adjust the amount of your recurring monthly membership fees at the start of the renewal term. We will provide you with written notice at least 30 days in advance of any such change, in accordance with the terms of this agreement. Please note that sales taxes and other fees mandated by government regulations are not included in your annual membership fee and may be modified or added at any time without prior notice, as required by law.

 

You are responsible for the timely payment of your monthly membership fees and any other obligations outlined in this Agreement. In the event that GO KIDZ is unable to process your payment on the initial attempt, we may make subsequent attempts to charge your designated payment method until the full amount is successfully collected. It is essential that you maintain a valid payment method that has not expired. Should the funds available on your card be insufficient to cover a payment when it is due, it is your responsibility to provide GO KIDZ with access to an alternative acceptable payment method to ensure full payment is received.

 

You acknowledge that if any card payment is not successfully completed or is reversed at any time during the term of this agreement, your membership may be suspended, and you may be denied admission to GO KIDZ until the outstanding balance is settled in full. Additionally, you understand that failure to complete or reverse payment may lead to the termination of your membership. In the event of termination due to non-payment, all remaining membership fees for the initial term will become immediately due and payable.

 

Please be advised that failure to utilize your membership does not exempt you from the obligation to fulfill payment responsibilities. Furthermore, it is important to note that there will be no refunds for any membership fees paid, regardless of the frequency of use, except as specifically detailed in this Agreement.

 

Privacy

1. Data collection : By enrolling in the program, you consent to the collection, use, and sharing of your personal information (including your phone number) in accordance with our Privacy Policy.

2. Communication : You agree to receive communications from us regarding your participation in the program. You can opt out of receiving marketing communications at any time, but you will continue to receive transactional messages related to the program.

 

Liability and Disclaimers

1. No Warranty :  The program, Membership is provided “as is”, “as available”, without any kind, either express or implied.

2. Limitation of liability : To the maximum extent permitted by law, GO KIDZ will not be liable for any damages of any kind arising from or in connection with your participation in the Program, including but not limited to direct, indirect, incidental, punitive and consequential damages.

3. Indemnification : You agree to indemnify, defend, and hold harmless GO KIDZ, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your participation in the Program.

 

Privacy Policy

GO KIDZ’S privacy policy, which describes GO KIDZ’S information gathering and privacy practices, applies to the Membership Agreement and is incorporated in the Membership rules by this reference. By enrolling in the Membership, you agree to the terms of GO KIDZ’S privacy policy and the use of your personal information as set forth therein.
